in ky if a parent whose name isnt on a birth certificate, but knows theyre the parent but doesnt make any contact or help financillay support the child, how long is it before its abandonment and what is done about this? is parental rights terminated?

Paternity has to be established first either by a DNA test or by the father saying the child is his. He would have to sign his rights over, it doesn't matter how long he has not been in the picture.

Now if he had left the child say for a week somewheres then that would be abandonment and he would probably lose custody.

You really need to consult an attorney about this. Both you and your wife need to go and sign the papers. I'm going to be blunt here. Is your wife seeing another man? I think so and I wouldn't be surprised if he stepped in to take your place sometimes during your absence. She may be setting you up for abandonment charges, so don't go anywhere but to your attorney's office first!

you should got to Court for child support, and when it comes time for the hearing, the judge will order them to pay child support. The Courts frown upon terminating any parents parental rights because it also bastardizes a child. (Not that I cam calling your child a bastard, that is the legal term) Most Courts refuse to do it, unless the case is really extreme. I'm a paralegal and your best bet is to get him in to Court and try to get child support, if he doesn't pay then he will go to jail, and then try to have his parental rights taken away, but the fact that he has not been there or taken financial responsibility will not be enough cause for the court to terminate. (Sad But true) Good Luck Sweetie! PS I seen the comment above mine that says if you have no signed birth certificate or court order, he has no obligation and that is a common misconception, but at least here is SC I know that is false. The law states, that no parent needs to be put on notice that they have an obligation to take care of their child, that is a given.

If they are not listed on the birth certificate and no court order has been issued, they have no parental rights or child support obligation.

There are things that can change the general in specific cases, so you should speak with a lawyer if you are involved in an actual case.

In most states parental rights don't "lapse" as with a piece of property. Someone (usually the State or the other parent) has to seek to have the rights terminated. It's not automatic.
