I've been told that blood test results that are above a .17 are considered a "High Tier DUI" and that the penalties are stiffer. Does anyone know what sort of penalties would be imposed on someone’s first DUI arrest with a clean record?

Ohio OVI

First Offense,
MINIMUM: 3 days in jail (or 72 hour program), $250 fine, 6 month license suspension.
MAXIMUM: 180 days in jail, $1,000 fine, 3 year license suspension.

Second Offense (within 6 years),
MINIMUM: 10 days in jail, $250 fine, 1 year license suspension.
MAXIMUM: 1 year in jail, $1,500 fine, 5 year license suspension.

Third Offense (within 6 years),
MINIMUM: 30 days in jail, $550 fine, 1 year license suspension.
MAXIMUM: 1 year in jail, $2,500 fine, 10 years in jail.

Fourth Offense in 6 years (or Sixth Offense in 20 years) is a felony.

If the BAC was refused, or was double the legal limit (which is called a high tier) then the jail time is doubled.

Could be. It depends on what state you live in, so Ohio I'm not sure about. I lived in Wisconsin and I know that anything over .08 was considered the same. You could be .09 or .3, the penalty would still be the same. I'm pretty sure most states are that way, but there's always small differences.

I have never heard of any difference in charges based on the amount of alcohol found. I lived in Ohio for 35 years.
