I am thinking of leaving my alcoholic boyfriend but I'm afraid that he will get partial custody of our daughter. I don't want him to be able to take her over night, but I would allow him to have her at his parents house for a few hours here and there. He has two DUIs, no driver's license and is a heavy drinker. He is nice to her when he's sober but he can't stop his drinking and I have to keep her away from him while he is drinking because he is sloppy and scary. He has never hit her other than a little spank which I put an end to. Right now he is only home a couple of days a week. We live in Michigan and our daughter is two years old and is still nursing several times a day. What kind of custody would he be entitled to?

Unless you can prove he is unfit and harmful either emotionally and physically he will have joint custody which will afford him visitation. But since she is 2 he may not get overnights right away. You have to consult your lawyer and the judge to put that in place.

since he drink heavy I wouldn't see any reason why he would have her overnight and being she is 2 why he would want to especially if she is still nursing.

Now a days, The Dads are getting a lot more rights then they used to. Joint Custody is more frequent than ever! I suggest you get a good lawyer and have him bring up all these issues of why there should be no overnight stays, or have them supervised if you deem necessary! You have enough proof! Also, they may still give him joint custody, but under a circumstance, maybe rehab? maybe daily meetings! Also bring up the point, that he has no drivers license! What were to happen if something went wrong in the middle of the night! What would happen? That is not good in an emergency situation!

He would probably get very little, especially since he can't even drive her anywhere. The fact that she is still nursing will help your case, especially in the overnights. You could have the courts probably mandate some kind of alcohol testing prior to visitation.

If the court system opens their eyes to the problems he has it sounds to me like he'll probably get supervised visitation. I would strongly recommend that you speak with an attorney and see what they say (they will not tell you that it will turn out this way or that way for sure, but they can advise you on what steps need or may need to be taken to insure supervised visitation). The only type of visitation any state would give him is supervised visits. They would considered him a danger to the child welfare. You should remove yourself and your daughter from that environment its not healthy.

unless you can prove he's bad he'll probably get the normal every other weekend and share holidays. i would leave him take her and don't tell him where you went right now you both have custody and not illegal for you to take her he would have to go to court and serve papers to you and if he don't know where you are then your safe can't get served.
