I was run off the road by a Drunk driver a couple of days ago, a man was driving 80 in a 25 mph zone and cut a hard left going towards me runing me off the road I nearly hit a pole. Im wondering if I can sue this person at all for anthing possibly? I was told by my friend who was in law school that I may be able to sue this person but im not going to legally consult untill i get some more advice. thanks

I am not "Fishing" for money AT all, people I was nearly killed by an idiot drunk driver and I have been seen by a pshyciatrist for constant thoughts about this terrible event...having constant bad dreams and so fourth...I am wondering if a case would pay for my medical charges for care ive recieved. thanks

What are your actual damages?

Were you hurt?
Was your vehicle damaged?

Without damages I don't see what there would be to sue for?

And trust me, the idiot will be paying out the rear for years to come, so he will "get his" without you spending an ounce of your effort or time.

You can't do anything unless your car was damaged. if that's the case then you should have collected his insurance info and made a police report. If nothing was damaged, then what are you thinking of suing for? You have no case and simply look like you are trying to find a way to make a monetary gain out of a possible opportunity. I mean sorry he ran you off the road, but if you or your car were not physically hurt or damaged, then nothing you can do. If the police came I'm sure he got reckless driving DUI what ever the case was, so he is getting a punishment for causing this.

sure, go ahead, but realize you've just described a guy that probably has no resources. so, you win the case and will never see a penny. while you're downtown filing the case, pick up some adequate insurance. EDIT to Add: here's the thing, you don't sue the driver. or ok, go ahead and try. but who you do sue is the owner of the car. that person is ultimately responsible. seriously.

I'm a paralegal, but I need more information. Like was your vehicle damaged, and were you hurt? If not then you don't have much of a case, because the police are already handling the criminal issue. If he had hit you and caused damages you would have a great case, but if not, unfortunately there isn't much that can be done other than charge him criminally which is already being done. Good Luck!

The only thing you can sue for, I would think, are damages. If your car was damaged, if you had to go to the hospital, if you missed time from work for injuries, etc. Beyond that, he's in the hands of the law now. Let them handle it and don't sweat it, just be greatful you weren't hurt.

I can't help but think that you're just looking for easy money here. If you have to ask what you can sue for, it sounds like you're fishing for an excuse.

Was there any monetary damage to you?

You cannot get monetary damages unless you suffered monetary loss. If you went to the doctor to be checked out, that would be collectable, and any time off of work to go to the doctor.

The reality is that it sounds like nothing really happened to you and you are looking for a free ride. If that is the case, I say that it is disgusting, and it is people who do this kind of crap who are clogging up our courtrooms so legitimate cases wait years to be heard. If this is the case, grow up and take some responsibility for yourself and stop looking to free-load off of the system.

Edit: Great. I am glad to hear that you are not fishing. Yes, all medical will be paid by insurance. Do not accept anything that states that you cannot further claim if you have further expenses. You might also be entitled to damages caused by your mental exhaustion. I would say that if you are not the free loader, get what you are TRULY entitled to and do not go for a multi-million dollar settlement, then best of luck to you, and be sure to get your attorney's fees paid by the other person.

One final thought...if they did not have insurance, you will get nothing out of them, so do not waste your $$$ trying.

If all he did was piss you off then the only thing is maybe a libel suit ?

Did you get so mad that you were unable to transact an important business deal that would have made you a couple million $ right then and there ?

This undoubtedly caused you a delay in your trip to __________ where you were going to _
________ which would result in _________ that will not now take place, causing you to___________ which requires re-investing $_________ at a rate much lower than what your life strategy had planned for !

If you were injured and/or your vehicle was damaged you have grounds to make a claim.
