my place was burglarized and ever since then my landlord has been harassing me, and is evicting me because of this. she refuses to allow me to have company over, without threatening to call the police on them. i have a year lease , but she refused to take the rent for this month and wants me out on the 28th.

I am a landlord. She can absolutely not do that. Read your rental contract and make a checklist of all the stipulations that warrant an eviction. This will help you clearly identify your rights in the contract and will help you effectively present your case to a lawyer.

By the way, you do not have to move out and can, in fact, occupy the residence until the court proceeding. She'll probably file for "unlawful detainer" and you'll be summoned to court. Now, listen carefully... prior to all of this you need to GET A WRITTEN STATEMENT FROM HER STATING THAT SHE WILL NOT ACCEPT YOUR RENT. ALSO, YOU WILL NEED RECEIPTS OF ALL YOUR PRIOR PAYMENTS. Also get a copy of the police report to present to your lawyer and the judge.

She is acting obsurdly and if you play your cards right, she'll look ridiculous in a court of law.

Lastly, do not play like a helpless victim when it comes to contracts and do not construct a "sob story" for the lawyer. Present hard facts and clearly articulate, either by evidence or information, your violated rights. You want to strengthen your position and act as if she has a leg to stand on.

Many real estate questions and answers depend on what state you are in. It is not your fault the place was burglarized, in fact is the property properly secured. I would have the rent placed in the form of a cashiers check, (of course you make a copy) in the mail certified with signature required. Having a 1 year lease is your ace in the hole! These people that say get an attorney must not know the cost of an attorney and have never worked with one! You might be able to file a complaint with the County Consumer Affairs or the Employment and Housing Department, I know the ladder helps possible tenant with landlords who discriminate!

If you have a lease then no, she can't do that. I suggest you take the rent and put it into an escrow account at the bank. I would call a lawyer to discuss with this with them also.

Most lawyers will give advice without a price tag attatched, you can get free legal aid if you look hard enough.

While she may be completely wrong, it may not be worth your while to fight this. See an attorney. If this goes to court, you will have to take off from work to appear in court or lose your case. Did she give you a written notice to move?
