It is the mother as she is the one who will be filling in the paperwork, If you are married then hyphenate.
I gave my son my lastname because my relationship wasnt stable, we broke up and I am glad my son has my name, as he is the only one who is left to carry on my family's name

I have heard of many people using the mothers name as the middle name and the fathers name as the last name. You can also hyphenate the last name but the first one listed is the legal one used.

Unfortunately she legally has the say. You should just try to let her know how much it truly bothers you without getting angry. Let her see that you are "sad" about it. If all else fails you can give your baby both of your last names. hers first and yours last. Alot of people do that.Good luck thats really sad im sorry for you :(

If I was not married to my baby's father, I would also want my baby to have my last name, not his... I wouldn't want my baby having a different last name than mine.

why not have it both. a hyphenated last name. say your last name is smith and hers is cook and the baby's first name is Charles. Charles Smith-Cook (usually dads last name goes first)
