This is a termination of parental rights and you have to have a good reason to do so. One common reason is that your children are being adopted by an ex's new spouse. If the Court accepts the termination of parental rights, your child support obligations end.

In most cases the Judges will still make the person pay child support even if they have given up their parental rights.

I have seen it done though when both the parents agree to no child support and giving up parental right. It was done through both parties having attorneys and then taken before a Judge. Some times the Judge will ask both parties a bunch of question before making the decision to sign off on the agreement between the two parties.

If you owe any past due child support then it is most likely the courts will make you pay it. A lot of it depends on what you and your x agree on and how the attorneys write it up. So be careful how they are termed in the written agreement.

That would depend on exactly what was meant by signing your rights away. if your parental rights are completely terminated then normally, yes the obligation to pay support (but not back support) ends. However each case is different and you should discuss with your lawyer.

Yes, you still have to pay child support. If someone else adopts the child, you are no longer legally responsible, but you can't simply sign away your rights to get out of you responsibilities.

If your parental rights have been terminated you are no longer responsible in any way for any present or future child support however you may held responsible for past due child support.

Even if it did allow the parent to no longer pay support any arrears will still be owed

That termination is only legal (as far as child support is concerned) if it is done in court. Back support would still be owed.

well they do say that if your rights are terminated,you dont pay but in my case, im still paying...my parental rights were terminated in 1998 case was open in 1995 they were adopted in 1998/99 and my checks are still being garnished......i worked 40hrs a week my take home pay was less than $50 for 2weeks and no i was not receiving any aid......i just quit my job....................

Your legal obligation would end when you sign the document. Back child support will still be owed. Why did you have kids if you didn't want them, and didn't want to support them?
