Your rights are to QUIT and not accept the behavior.
You can also turn the check over to the police department once it will not clear as it is a crime to issue a check without funds to cover it.

It really depends on your jurisdiction. Generally speaking, bouncing a check is a crime and you can report him. However, there needs to be proof that he intended to bounce a check on you.
On the civil side, almost all jurisdictions allow you to sue the employer personally for the amount due and owing. Therefore, the employer would not have the protection of his corporation.
If this is a chronic problem but the employer covers the check eventually then you should consider charging him interest and a bounced check fee.

I had a boss like this once.
Take your check to the bank the check is drawn on.
Sit down with your boss and tell him you aren't working for your health. Tell him that if he can't pay you on payday that you can't work.
Here is what is going to happen: he is going to file bankruptcy and close his doors if a miracle doesn't happen. If he doesn't have the money to pay you, he probably isn't paying his employer taxes either. So eventually the IRS will come in and seize all his assets..
Start looking for another job now. Never deposit his check in your account.

The employer is committing a criminal act , as issuing a cheque without sufficient funds is criminal act . You can invoke criminal law against your employer and also
institute proceedings for non payment of salary in time before the appropriate labour department. But , mind you you will be incurring the wrath and displeasure of your employer !!

If they are not paying you on or before payday, you are entitled to legal recourse - any banking fees you might incur for attempting to cash a bad check, and interest you could muster up, court costs, etc. Probably a lot more then that.
Although suing someone who has no money = not really effective. It is not unreasonable to require them to pay you in cash, as their checks have proven to be worthless.

You need to report him/her to the Department of Labor - Wage and Hour Division in person. Look in the phone book under U.S. Government. When you get there,ask to speak to an investigator and explain in full detail what your boss is doing.

When you get the check call his bank and see if it is good. If is is, take it to his bank and cash it. Don't deposit it into your bank because you will incur bank charges.
You can find another job and quit. You can also report him to the wage and hour board. They can put a stop to it.

it happens to me every week. the lady at the bank gives me a look like she thinks i am scum but its not my fault my boss is an idiot. he is friends with the bank manager and i guess they got something worked out or the golf course.
