I was served with court papers recently due to a credit card debt that I have from a few years back. They are taking me to court in an attempt to garnish my paycheck for $$ owed (approx. $1000) If this were to happen, it would create a hardship for me whereas I would not have the $$ to fully pay my everyday household bills. I was thinking about contacting a lawyer to see if they could help me in trying to get this modified so that 10% of my pay would not be taken every week. I was wondering if anyone has had a similar experience in this area. Would contacting a lawyer be worth it, and do you think they'd be able to help me out? If I do nothing, they will definitely win a judgement against me, and the garnishments would begin. Another option I was considering was to contact the plaintiff to see if we could work out a payment arrangement with them instead of going to court. I'm just not sure if I can do that at this time since the papers have already been served.

Most lenders prefer to settle. It's free. Start there. An atty isn't really going to help if you lose a garnishment action; the amount the winner can take from you is preset by state law and an atty can't change that. If you owe, you'll have to pay.

Appeal your case and request for payment in installment instead of the garnishment against your wages.
