My stepson is with his mother's current motherinlaw (not with my motherinlaw) witch is my husband’s son. My stepson's mother is drug addiction. When they went to pick him & his baby sister up (her new baby with her current boyfriend) they ask her whom she wanted the child to stay with & she said her current mother in law. I don't understand how they would let a mother in those conditions choose whom the children would be with thought the court dose it for her & they never contacted my husband & I. Much less the grand-mother .how dose that work? It’s in San Diego county Ca.

Your husband must file for custody. She probably never even mentioned him, how would they know he was in the picture otherwise?

Usually, courts try and place children with a relative. If they know that a relative is unsuitable due to criminal behavior they will look elsewhere. If you are aware that the child is with someone who is involved in drugs, criminal behavior or other activities that could place the child at risk I would advise you to call and send a certified letter to the child protection agency and the court notifying them of your concern. I can tell you when a biological parent is not asked to assume custody it is often due to concerns about that parents history, especially if it involves domestic violence or sexual abuse of a child.

If, at the original divorce, the fater signed away rights, then he wouldn't have rights. If it was decided that the mother has all custody, then the father wouldn't have rights. If they just needed a quick place to place the child for a while. it was the first sugestion and the father should go to court to work it out.

Why isn't your husband going for full custody of his Son instead of leaving him with a drug addict??? Your husband can go get his Son if he has any kind of custody! Why would he leave a child with a drug addict or the Mother of a drug addict???

Courts look first to parents when trying to decide custody. If neither parent is suitable, other relatives will be sought. If no suitable relative can be found, the child will likely become part of the state's foster system.

Legally the 2nd choice in all cases is your husband, the child's father, unless your husband has given up parental rights or been found unfit.

Maybe she didn't say anything about him at all, they might not even know he is around. Have him file for custody, he should get the child ♥
