This is what I would do ,Sneak down to the impound yard about 3 o'clock in the morning with a big steak,and a pair of snips ,Cut a hole in the fence toss the steak to the Dodie waiting for ya and grap the moped ,leave a sign in its place reading :Screw you Johnny law: Then I would sale registered 50cc moped for cheap. Next morning go to impound yard to retrieve your Impounded bike . After they tell you somebody has stolen it you can file a lawsuit and use the money to pay ticket and buy a loud obnoxious Harley

the bike would be inpounded, your probably gona go to court for no insurance. as you were probably only insured for a 50cc. Not to mention any other laws you may have broken, like you dont have a licence to cover the 125cc bike, the road tax is for a 50cc not for a 125cc
The bike was took of you as you couldnt legally ride it on the road. There may be impound and release fees. I would get in touch with the police to find out what your options are.
If you bought the bike as a 50cc and on the logbook its a 50cc but the previous owner changed the engine but didnt notify DVLA or you then you may be able to plead that point in court.
But if you bought a 125 and tried to pass it off as a 50cc your best bet is to go to court plead guilty and if you can get your bike back make it legal by either registerig the new engine cc or putting a 50cc motor in. I dont know if the police will insist a garage does it

I'm sorry to say that is going to be the last you saw of that bike.
Also the garage that wrote the MOT are going to get a visit and they ain't going to be that happy either.
Here is what happens, First they will ask you to produce your documentation for the bike in question ( the 50cc) you will produce what you have and they will say No the bike we took from you and impounded.
THey will examine the MOT to see if it is a fake, they will examine the insurance to see if it is a fake they will look at your licence.
Now if you have not yet attained 17 years of age you will be driving otherwise in accordance with your licence and could face a years ban or maximum points on your licence.
There is a heavy penalty over £1,000.00
Secondly they will look at yuor insurance which says MOPED and yuor bike is a 125, if that is the case you will face a summons of no insurance, fail to produce insurance that is 6 points on your licence and a heafty fine over £1000.00.
Now no mot.. As a 50cc bike isn't a 125 and you will have to produce 2 MOT's for the same vehicle which you can't do cos the bikes been impounded, this is only a £20.00 fine and no points but was it altered in any way.. this is uttering a false instrument and fraud and holds a prison visit of up to 10 years.
Oh and now the bike No insurance no mot and on the road, Where did the 125 engine come from? was it legitimate if so the most you'll be up against is construction and use offences as bike lights and reflectors are differentr to those used on a moped and so you could face tyre, light, dangerous parts, offences each have a whacking fine and some have points on your licence.
Also while the bike is impounded it is costing storage at about £25.00 a day now they won't release it until you produce a valid certificate of ownership, valid certificate of insurance MOT and some one who can drive it away ( cos you won't).
And on top of that section 136 of the road traffic offenders act gives the DVLA and the police the power to reduce your bike to an oxo cube.
Oh and then they'll ask you politely to be a witness in the prosecution of the owner and runner of the MOT station for the dodgy bit of paper you have produced.. Hmm and they have mates who have mates who own bikes who have long hair and.... get the picture....
Take the rap. Get banned for two years plead ignorance to the modifications and get your photo in the paper as another poor dude who got ripped off with a dangerous bike and offer to have your photo taken of you pulling the lever setting the crusher in motion along with the smiling assassin of a copper who saved your life and ask for mercy over the fines as you've been such a good egg

Where did this happen? Some posters are giving information for the UK- you're in big trouble there. If this happened in United states give the state. Make and model of vehicle would be handy also. From the post you seem to have scooter that was registered as a moped which in many states is a 50cc maximum, but the scooter is actually a 125 engine? If you mean a moped with pedals like a bicycle besides engine? May vary on engine size , 130 cc might be Kansas. In US a license plate and possible drivers license violation depending on where you got the vehicle, simple fines and replate, get license upgraded. Did you buy the vehicle with paperwork that said 50cc? Did you get it from a dealer and changed the paperwork?- you're in trouble for falsifying document. Did you get it from a private party and just copied size info to your registration application? You can dodge the invalid class fines by showing someone else falsified document for engine size. Important details missing in question.

you will be better of waiting to get a 125cc.. as firstly.. your moped will be restricted to only 30mph.. and you will end up getting frustrated with it... however... the moped will be cheaper to insure! but i would wait as 125cc arent much dearer than a 50cc

There is no such thing as a '125cc moped'.
A moped has an engine of LESS than 50cc.
It is illegal to register a 125 as a moped. Chances are, it will be crushed.
