A restraining order is put on a minor against an adult. The minor can lift it when he/she turns 17, but can anybody lift it before then? How would you do that?

For NY, does the minor petition the judge? Or the adult?

The judge, if petitioned by the person who has the order against them.

If the person who requested the order asks for it to be lifted it still is not valid until the judge has a hearing ?? No hearing has been set in my case yet

Unless U are running a rehab clinic in ur home...there is really nothing U can do to help her! She needs professional help to come off the heroin! Heroin is a drug that is not easy to give up. There are SERIOUS withdrawl symptoms! And most people can not quit on their own! Ur 1st priority is 2 ur child & ur household! It is her (ur sister's) responsibility to get her own life in order. Unless she is still under 18..then it is ur parent's responsibility! This might sound harsh, but U need to keep that restraining order in place until she has proven to U & ur family that she is well! DO NOT REMOVE IT UNTIL THEN!! She (ur sister) is simply trying, once again, to get her own way! Once U have lifted it, I would almost guarantee that she will return to her old ways of making your life a living hell!! Talk to your parent's about her! See what treatment options there are out there for her. If U can not afford private rehab...then there might b welfare funded rehabs (State run) for her to get into. But make sure that U thinks & do for your family 1st! She might b ur sister, but she is not your child!

The issuing judge lifts it. The minor merely requests it.

The courts are the only ones that can lift such an order. You would have to petition the court system.

The judge who issued the order, or an appellate-level court.

The procedure may differ on a state-by-state or a county-by-county basis. Hire an attorney in your county to take care of it for you.
