and you have not stolen anything? We have one store in the area that the danged buzzer goes off almost every time a customer goes through it. I suspect a cell phone signal might set the danged thing off. It's embarassing when the store clerk comes running after you and checks your bags. I told them if it happens again, I was going to sue them for deflamation of character.

Sometimes, if they are busy and the thing goes off, they just keep waving people to go through. I am half tempted to take a TV off the shelf and not pay for it and leave on those days. LOL! That'll teach them!

But isn't it embarassing enough to sue them? (Not that I would, I am asking hypothetically)

If the lady who spilled McDonald's coffee can sue and win, surely this case would make me rich. LOL!

Think I should do it?

My damages would be public humilation because everyone thinks I have stolen something whent hey see the employees going through my bags. They do it right at the front door.

No-you have no right to sue. This act is not intended to cause you embarrassment or single you out as an individual. The McDonald's coffee lawsuit has taken on the proportions of an urban legend. That happened in my state and I know the judge. The woman did not win millions of dollars--she won about $480,000 because Judge Robert Scott ordered a remittitur. McDonald's had over 800 written complaints about their coffee being too hot and they made a deliberate, corporate decision to ignore the complaints. The woman who spilled the coffee in her crouch was burned literally to the bone. The McDonalds's coffee was at least 20 degrees higher than any other restaurant's coffee. The jury was appalled at McDonald's callous attitude to the 81 year old plaintiff; they had settled over 700 previous lawsuits on the same issue and had never consulted a burn expert. The injured woman was in the hospital 7 days and required several skin grafts; the victim had never sued anyone before in her life and McDonald's refused to pay her medical expenses. McDonald's knew about the danger and had no plans to lower the heat or post a warning that McDonald's coffee is the hottest in the fast food industry.

When I worked at Walmart sometimes the companies that sold Walmart certain products would not put the security tags in the right places where we could get to it to deactivate it properly. Then that would cause the alarm to go off on people. They told us that they logged that in and if they noticed that certain products were doing this more than others then they called the company and told them to fix it or they would no longer buy their products. I think people should understand these days that the security gates go off on all people. I don't think you should be embarrassed. We were always supposed to check things not in bags so I don't think you could carry out the TV without anyone noticing. I always hated being put at the gate to cover a door greeter's lunch or one that had called in sick. It's the most boring job in the world.

You can sue for anything, but you'd lose this one and wind up paying the store's court costs. They caused you no monetary damage. You wouldn't collect for deflamation (sic) of character as they did not deliberately spread falsehoods about you to embarrass or harm you.

The day you decide to take the TV off their shelf, let your family know so they can come visit you.

not unless they run after you spread you on the floor and give you a violent body search,which is unlikely.here on most stores no one bothers.I remember I got some books and the till operatop did them all in front of me with the magnet thingy,or whatever it was.Anyway as I passed the security thing by the door,it buzzed,so I turned back and looked around,no one was even looking at me,so out I went again,heard the buzz,and got back in,looked around,they were all buzy with other customers and jobs in the store so I just gave up and left.it did buzz again but to hell with it I thought,either fix it or switch the dumb thing of.I mean what was the point of having it ,if no one bothers anyway.

Basically an unwritten law that you agree with the stores terms when you enter. On the upside, store theft costs every customer who shops there. Last I heard, 3% was added to prices to make up for the things stolen.

I don't think you could win, since it happens to anybody else, but it is embarrassing, I feel dirt poor when it happens, especially when all I have is a tiny little bag and they still go through it...

uh....no. Because any machine is laible to make a mistake; a buzzer going off is not in any state a formal charge of anything; it's an advisory.

Yeah, because that's just what this country needs. More frivilous lawsuits to tie up our court system and spend taxpayer money. Get over it and stop being so offended. God in heaven, where do these people come from?

i don't think you could sue them. they have the right to have the security thing, even if it does goes off at the wrong time. if you don't like it, don't go there.
