if it is really happen why we call it as "legend" ?

Narrowly speaking, The Black Legend (Spanish: La Leyenda Negra) is a term coined by Julián Juderías in 1914 to describe what he thought was a systematic exaggeration of Spaniards' cruelty and intolerance in anti-Spanish literature. Since then, the term has come to mean any systematic exaggeration of cruelty and intolerance, not necessarily related to the Hapsburg Spain.

Why is it called a "legend" if it really happened? Because contemporary authors often exaggerate or use metaphors which later generations take at the face value. Even worse, authors that we think of as contemporary often wrote decades after the event, usually based on hearsay...
