The mother, if unmarried, has the legal right to give the baby her last name. If the dad wants to admit paternity and give the baby his last name, he has to sign a parental acknowledgment form as well as the birth certificate ( I live in D.C.) Overall, mom has the legal authority regarding naming initially. Who knows what a court may decide.

I think you both would have to agree on a name! Because You both are going to have to fill out the paperwork for the birth certificate Your going have to decide on a name! Theres no legal issue about it! You both should sit down and make a compromise Even if it means deciding a whole new name!

Whoever fills out the birth certificate decides. In my case?
My Mom changed my middle name from Landon to Lynn when my Dad stepped out of the room to fetch her a cup of coffee! If you had DNA proof of parentage AT THE TIME OF BIRTH, this would be an interesting court case, though it would mean your baby might have no legal name at all for years to come. Yipes! Good luck with the baby, and especially with the divorce that may come.....

If the two of you can't decide the name of a baby without talking legality how on earth are you going to decide on how the raise a child? Now would be a really good time to learn compromise.

It is ultimately the mothers decision since she will be the one filling out the paper work at the hospital. It is sad you can't agree. As far as having your name on the birth cert. or even the child having your last name, you must be there to sign. It can be done afterwards, but it requires more paperwork, notarizing, sending to the state and an additional fee.

I believe its your wife who gets to decide. Thats how it was when my son was born. My husband and I have different last names so we gave our son a hyphenated last name. Its worked out great and actually a lot of kids in his school have hyphenated last names. I hope everything works out for you.

Someone came into my room in the hospital to get the information for the birth certificate. My husband wasn't asked for anything related to the birth certificiate.

Whoever completes the birth registration form.
Usually it's the mother; it's presumed she knows the father.
Additional names can be added at baptism though.
