Then that person should be let go. Did this person get put in jail for a period of time? Then they might be able to sue the county or the city that put them there, for damages. It all depends. Get a lawyer, though.

Use all the negative test results as defenses in court to get your case dismissed.

Of course, as I would often say to folks who denied being stoned/drunk/etc. - "I hope for your sake you are on something, 'cuz I'd hate to think you'd act like this sober."
