Ok so I worked at CVS since Aug. 2007 and this girl that got hired 10 days after me was paid more than when she started out 10 days after me. I just figured this out because we were talking about our annual raise that we got and I asked her how much she makes and I was told 7.25.
Then also I find out that she started out at 7.00 and I started out at 6.85 which is minimum wage in my state.
Me and this girl have the same job title which is service clerk so there is no need for the pay difference.
When I was hired in I asked how much us service clerks make and I was told minimum wage so I assumed that it wasnt possible to negotiate your pay.
Also to add to this story my friend that got hired after this girl also makes minimum wage.

So after all that I need help on what I should do in this situation. Should I seek legal help or should I go to the crappy union we have.

Entry level positions often will pay differently depending upon the employees experience, hours available, if she was already a member of the union as well as how the individual negotiated their wage upon hiring.

There is absolutely nothing illegal or even unethical about paying employees differently based upon those factors.

This is not the case. The reason most men are paid more is not that women have less hourly pay, but that men typically work more hours. If this gap in wage were true. It would be insane for most companies to not hire as many women as possible. This is not the case in the United States of America.

It's always possible to negotiate pay. Whether you do it or accept the minimum is your choice. I guarantee you have no legal ground to stand on. It's none of your business what she makes and as long as you are being promoted and given raises fairly it's really all that matters. You agreed to work there for 6.85...that's the contract you signed. What she did is her business.

A company has a right to pay anyone any salary they choose as long as it is atleast equal to the standard minimum wage. If they choose to pay someone more for whatever reason they want they have that right. Maybe they feel you are a Problem Employee and the other is not? I can see by your complaint that maybe you are a Problem Employee by comparing your salary to someone elses and feeling that company time alone guarentees you top salary.

Pay a lawyer over 15 cents?
Clarify with your union what the pay scales are and what, if any merit there may be to pursue issue.
Meanwhile, consider looking for a new job.

the crappy union is cheaper than a lawyer at the rate of pay you get. so go to the union

just suck it up and if you don't complan maybe your got a raise. she could of had more expierence if she did that might call for a bigger raise
