I am divorced and pay my ex wife support for our three chldren. I understand that the amount I pay is strictly a calculation of percentage of my income, but my question is what if I remarry? I have been told that my future wife's income could be counted in with my own, therefore forcing me to pay more. That doest seem right to me, because my children are not my future wifes. Why should she be forced to pay for them too? I would think that it would be based on just my own income, but I don't knnow for sure. Does anyone know what the new york state laws are for this?

That is not true. Whatever is stated in your decree and your child support document regarding your three children is it..

Just because you get married does not mean your new wife will have to support your children as well. Now, if she chooses to contribute some of her income to you to help support your children she can. But it does not have to be done by law!
Who told you that! They were Bull S------G you!


If you choose to remarry again, you will be taking care of your new wife and other responsibilities but that would have no weight on your previous duties to your children..(That's a fact)!

I used to work as a county clerk for support in NYC!

They will not include her income, just yours. If you remarry then you would still have to pay the same amount unless you ask for a modification, which may not always be granted. If you end up adopting step kids or gain more dependents then there may be a modification there as well. Or if her husband adopts your kids, granted you give away rights, then you wouldn't have to pay them anymore. So basically, you are paying child support until they are at the legal age to not get it anymore or when you give up your rights.

untrue...google new york + child support...has all the info for you there...you do have to pay until they are 21 in new york

I doubt you would include her income in any calculations of support. See link below.
