do i have to first file with the eeoc or just get a lawyer.

If you are going to sue under a Federal statute, you need to write to the EEOC before you can bring an individual lawsuit. You can either do it on your own or hire a lawyer. You only have a certain period from the last discriminatory act in which to notify the EEOC (e.g., it's 300 days for the Americans with Disabilities Act). Take a look at the EEOC site. It has pretty readable guidelines on it about how to sue. www.eeoc.gov.

Under state law (depending on your state), you may be able to go directly to court. Your state probably has a web site on which you can find the right agency to contact (or you should find the correct one with a few calls). Although you could do this yourself (pro se), I would recommend getting a lawyer if you are going to a court. But, don't wait too long, because your states' civil rights laws will also have limitations periods (periods after which you can't try to sue).

In "most" States you have to file with the EEOC first and get a "right to sue" letter.

A lawyer who prosecutes descrimination lawsuits will probably not charge you until there is an award, so it won't cost you anything to get one first.
