I have a Saab which has been in my garage for almost a year because it needs an engine replacement. The engine died due to an issue with sludge. There is a known defect with the engine, but Saab is refusing to replace it because I cannot produce all oil change and maintenance receipts for the 6+ years I have owned the car. I have seen from various websites that I am not the only one going through this.

you cannot..
you should have read the warranty/insurance rules
you should first provide them what they ask to you

Good luck. Your warranty agreement is a two way contract. It and the owner's manual describe the maintenance required to hold up your end of the bargain. I am sure it states clearly in the agreement that you should maintain records of all maintenance performed. Even if the manufacturer does not require it in writing, no judge will allow you to claim you performed maintenence per the ageeement unless you provide evidence proving your case. You bear the burden of proof. No records, no settlement.
