i am married since 1 and a half year. i m living separtely from my wife since 9 months. we dont have any sort of understanding. m very much mentally harrassed by her. we dont share a gud husband wife relationship physcially and mentally.
i need divorce but she's not filing any case and is not ready to go for mutual consent. i dont want to file any case against her myself cos otherwise i'll need to pay money...which i cant afford. and also m worried if she files any false case against me for dowry. give me a suggestion as how can i easily get a divorce without paying much money. i want the case to finish as soon as possible. also we dont have any issue(child)

You were married for 11/2 year & separated for 9 months. So, in total you both stayed together for 9 months which I feel is a too short time to know eachother.
If you are really a mature & intelligent man, take the lead first--1. Stop listening against her from anyone from your side. Tell them to shut up or tell them you will leave them & live alone.

2. Talk to your wife alone & if she is scared then no harm let it be in front of her family, repeatingly feel sorry, you won't become small by this, on the other hand you will show your intellect. Tell her you believe in this pious relationship & if you commit any mistake she should tell you & you will never lose your temper.

3. Then immediately consulting her go out of station for a week & there you will not point to her mistakes but you will tell about yourself right from the childhood days--- & ask about her,NO force. But ultimately keep in mind it is you who can save everything.

4. Second marriage don't even think--you first try this & let us know. Physically & mentally it is you who have to take lead first till all is allright. I know you can do it---So TRY-----

You sound like a great guy. You got married and decided after a few months it wasn't going to work. Now you just want to snap you fingers and make your mistake go away! Maybe you should have taken the idea of marriage a little more seriously.

Its good that you see children as an "issue." You are obviously a very mature individual. Maybe you should grow up a little before getting into anymore relationships.

u need to speak to her and make her understand that things are not working inspite of ur sincere efforts, try to use a platform where elders can sit and talk abot it. someone has to start the talk.dont wait for anybody u initiate the talks.and try to sit with her if possible and explain the situation with an open mind. if nothing works go and meet a lawyer who deals with family cases. he may be able to give u technical ideas on regard to the situation where u have come across. you have to understand that the law and the society is more favourable to women. on regard to the fear of false dowry case file a case in the local station that you are having an apprehension that ur wife may take u for a ride in this issue. consult ur lawyer and do it at once.

well you will have to file a case under section 13 B of Hindu marriage act. even if your wife files a case for divorce u will have to pay maintenance under section 125 crpc. u may file a case under section 9 of HM act and call upon ur wife to stay with u and if she feels that she cant stay with you she will be forced to file for divorce. In first case ( Under Sec 13 b ) u will get divorce after six months. if u prove that ur wife can maintain herself and you don't have much fund or salary you wont have to give money to her. in some case the court may even ask the wife to give maintenance to husband.

Considering from your grammar I assume you dont have a great job. There really is no easy way to get a divorce. You should really not have any problems if there was no physical abuse towords her. Besides you have no kids you shouldn't owrry about it.

Well, I think that you have one good reason mentioned by yourself earlier on!
Sexual incompatibility.
You can say to her.
Besides, if you're not fighting against anything, property, possessions, etc...
If you don't want to ask for anything then, I reckon that it should be a bit less expensive!!!!
You could also ask for legal aid if your revenues are not very high! Talk to your solicitor!
