You can file any time. They will begin to take it at the date of birth, but in some states, they will also make him share in the responsibility of paying the bills for the birth. At the very least the order will be from the date of birth, even if they actually start taking it from his paycheck after the birth. The order would still be dated or backdated to the date of birth. If you file after the baby is born, it is dated to the day of seperation.

You will ask for child support when you file a petition for divorce, but you should expect that it be questioned as to who the father of the child really is, they, referring to your husband and his attorney, will ask the court for a paternity test, to determine if he is the father of your child which requires DNA testing, which is in most cases very costly, so if by chance it is not his, I suggest that you let it be known, because if proved that he is not the father, you will get the bill, the other thing to consider, is the divorce laws in your state, not all states dismiss extra marital affairs, so talk to a good attorney, or you could end up with nothing at the end, except a child to raise on your own.

basically the same time you file for divorce or legal seperation with the courts. Nothing will happen for the support til the baby is actually born though. The Judge will defer his decision til after the birth date. Good luck and Hapy Holidays and congrats on your baby

go to your nearest court house. child support is one issue and custody is another. you have two different issue, and two different court dates, such a pia, try working out arrangements, the courts are a horrible way to go. but if you can't work something out, get there now and start the process, will take a while.

Why did you breed with someone you werent getting along with ?
Why not try marriage counseling. The question you asked depends on the state, how much he earns and how much you earn. Lots of variables you'll need a lawyer.

I think you may be letting your hormones get the better of you. Let the baby's father prove he's the man. Stop finding fault.
