For the restraining order to be valid, it would have to be served on you. Until it is validly served on you, it is not effective, even if it exists.

Good luck,

These answers are incorrect. Technically, and by law, you are supposed to be informed of a court date in which you are allowed to plead you case. However, given the fact that restraining orders are nothing more than a form of legal harassment and reside in an incredibly corrupt system, many people often find themselves subject to false restraining orders with no way of knowing how to fight it.

A restraining order is not kept secret -- you would be served with the restraining order and it would clearly state the terms of the restraint and who it effects. It would also tell you that you would be subject to arrest should you violate the terms of the order. You would be wise to be pro-active and make a phone call or visit your local police if you think that an order exists. One only has to watch the nightly news to appreciate that bad blood in relationships can be dangerous. Worry enough to protect yourself -- better safe than sorry!

You would also be given the chance to defend yourself against whatever he's accusing you of, once you've been served. You can't just get a restraining order on someone because you feel like it. He'd have to demonstrate you did something to deserve it, and you will have the chance to show he's lying.

Yes. If her dad has a valid restraining order than conceivably he could have you put in jail if you violate the terms of the restraining order.

Contact the court they might help you or local law enforecemnt could probably tell you how to find out.

It must be properly served on you to be effective. This means someone has to give you a copy of the order.

Oh, you'd know. There probably would have been a court appearance required, or at least a visit from your local sheriff.
