In the United States, you can sue anyone for anything. You must give fair notice to the person you are suing in the form of a summons so that he may be in court to defend himself.

The easiest way is to simply hand the summons to Santa when you see him. Hide behind the Christmas tree and hand it to him when he comes out of the fireplace.

IMPORTANT: He must reach out and take possession of the document or you have not properly served him and he won't have to show up in court. You can't just slip it into his belt while he's heading back up the chimney.

I don't know about other States, but in California you can make 2 copies of the summons. Mail one to his legal mailing address and hand deliver the other to the same address. This constitutes proper service. If he doesn't show up in court, you win automatically.

Unless you can explain the milk and cookies, I wouldn't bring up the breaking and entering thing. ;o)
