i was on short term dissabilty for 6 months my doc. released me back to work on permanent light duty whe i took my paper work in the HR person handed me a voluntary resignation paper and said ths is what you need to do we have no work for you. also will not pay my vacation becouse there policy is you have to work one day after your anniverciry date to colect it i informed her i would work the one day i have 104 hours of vacation coming

i have a serious medical problem my doctor will not allow me to work any more. and im in no way a lazy person!!!!i hate not being abel to work

i was advised by my doctor 2 years ago to stop working.

Maybe, maybe not. Reasonable accomodation to disabled employees must be offered by many employers under the federal Americans with Disabilities Act.

Whether that applies to your situation, I cannot begin to say on these facts.

You can always be asked to voluntarily resign, but you'd be stupid to do it. If you volunteer to leave, that puts it on you. If they fire you, it puts it on them.

Make them dismiss you, and file a complaint with http://www.eeoc.gov if you feel you've been discriminated against on the basis of your disability.

Yes. They probably can't fire you for that reason (in this specific instance) so their only hope is that you'll resign.

They can ask you to, but you don't have to.
