legally you can't without consent...you go to court and petition name change..judge will ask you why...and ask if father agrees or disagrees...at that point....judge will ask if father has been notified...if not...he'll order copy of petition to be sent to last known address of father...you cannot LIE and say you don't know..if you really don't know..then you must try...I used 1800ussearch and found my sons...if father agrees then no problem..name will be changed..otherwise judge may not agree if father doesn't want the named changed...that's how mine turned out...my son is 16..we just did this last year...so since we can't do it (judge said no)my son is going to do it at 18...I and my son wanted his name changed because he has really no ties with that side of family (their choice)...not really sure what you reason is...if the man is an active participant in child's life...just leave the name alone...so many ppl want to change or remove the fathers name for all the wrong reasons...so think about long and hard before doing anything..good luck

Children don't ask to be born and they don't ask for their parents to get divorced. There is nothing that replaces the feeling of beiing loved by both parents. Children are a part of each parent and by changing the name you take away that part of the identity. The father might be absent, in jail or an total *** hole but the child is still made up of part of him. You take that away and you are telling the child that 1/2 of him is no good.
PAS, parent alienation syndrone where one parent denys the child his or her rights to know, love and be loved by the other parent because of one of the adult's own feelings. You may think you are protecting the kid but you are going to see reactive behaviors as the kid grows up and you will wonder why "after all you have done"
Let me guess, you want to change his name to your new boyfriend's! Ya better not!

the boys are who their dad is which is their last names by law. i hope you need his consent which am sure you do. he is their father regardless of whats going on with you and him. stop putting the children in the middle or making them suffer for you hatred towards their dad. so what you have full and physical custody he is still their dad. grow up and make decisions in the best interest of the boys and not whats going to make you feel good and making him mad.
