We and my husband got in a fight, and we ended up in jail for 1 day. The judge gave us only PTR, not any bail, and we agreed to not fight again. We want the charges to be dropped, bcz if they arent droped, my husband will be discualified for his current job (i dont work), and we wont have money to pay for my leukemia treatment. How this can be done?

You can't, because you didn't actually charge him, the district attorney did. All you can do now is go in front of the judge and explain your situation and see if he will dismiss the case.

If it's a small town where you can get access to the DA, ask him or her nicely to drop the charges and see if they'll do it for you, but don't hold your breath. In many states now they don't have the option to drop DV charges, it's legislated that they all have to be adjudicated once the paperwork is filed.

Why would you want to drop the charges? This is a very typical situation where wives and girlfriends call the police, the police come and help, then they decide they are in love again and don't want the other half in trouble. In my experience as a police officer, I will tell you that if you do not follow through with this, you will be sending a silent message to your husband that it was ok to put hands on you. If you think this will not happen again, you are completely wrong. In fact, it will most likely escalate in nature. The domestic violence laws are now set up in such as a way as to protect people like you from themselves. It has long been recognized that wives and girlfriends (not that males are not victims) will often recant their versions and allow someone who committed a criominal act to walk away without punishment. For this reason, you taking back your version of saying you lied will not work. The court system and local law enforcement will most likely follow through with the investigation and prosecution based on your original statements. As they should. I have seen many times in my career, the same woman getting battered month after month, and each time it is the same, why did it take you cops so long to get here? I want him in jail! He tried to kill me! Then an hour later they are at the jail trying to bail out Mr. Wonderful. Think of yourself first and remember that he will do it again. It's a matter of time. It goes in cycles and after it happened, he was sorry, he didn't mean to, he loves you etc. But it will come back around and happen again. Do what's right and make him realize he can't do that to "someone he loves."

At the prosecutor's office where I am employed it is standard operating procedure that we do not drop Domestic Violence charges.

However, it has been done in extraordinary circumstances. Those tend to be fact specific and is very rare.

That must've been some fight to land you both in jail. I would think you need to speak to the judge through an attorney.
