I got in an accident and my girlfriend said she was driving when the chp showed up. She had been drinking and got arrested for a felony DUI. I was actually driving but not drinking. I was scared and in shock thats why I said I wasnt driving. I want to fix this when she goes to court because shes getting charged for something she didnt do. Any advice?

depending on where you live and what State or country you live in, but most countries have a law for this type of behaviour. There is a likleyhood that you will be charged for failing to report an accident, while your girlfriend will more than likley be charged for "Knowingly making a false statement," and or "creating a false belief," by filing the traffic statement,

What sort of man lets his girlfriend take a felony rap for something that he did?????

You can go and tell the cops the truth - but don't be at all surprised if they refuse to believe you. They'll probably assume that you're trying to get her off the DUI since you were not tested for DUI as you were - they thought - not the driver.

The probable end result? The DA will ignore you and prosecute your girlfriend anyway. He might even charge you with lying to the cops for claiming it was you not her that was driving.

On a felony DUI she can expect to go to jail for this, plus lose her license for a year, and then when she DOES get it back, her insurance will go through the roof.

Yes, you need to tell the truth, but your freind may face filing a false police report and/or lying to the police for it!

Do the crime, you need to pay the time!
