I am making a website and I want to use a screencap for the banner at the top..is this against copyright laws?

A screencap of what?

If the image you're using is copyright, then your use of it - however you got it - is a copyright infringement.

So what images are copyright?

Well, *almost* all photographs are copyright as soon as they are taken.

All other images are copyright as soon as they are made - paintings, digital artwork, cartoons, etc etc.

Once copyright, an image stays copyright for a various number of years, depending on where you are, and where the copyright first attached, but in any event it's "decades".
