My husbands friend owed him money and he decided to pay a credit card for us. Everything went through fine, but he heard a week later that his friend may have used a stolen checking account. What should I do? What can possibly happen to me?

If HE did not own the account, the check IS bad and YOU owe the bank for the value of the check AND any 'bad check' fees. You would then have to sue HIM to recover the full amount. Legally, you have a 'slam dunk' case, but I doubt you can actually collect. He has proven he is not reliable in that regard.

If you SHOULD have known (that is actually a legal term) that the funds were not his, YOU could be guilty of fraud. In this WORST case scenario, you COULD face criminal charges. If they believe you are also a victim, it should not come to that.

you aren't safe -- yet

1. suppose that what you fear isn't all of it? suppose 'friend' made a copy of the credit card bill and then used that information to steal the credit card account.

your husband needs to immediately call bank and verify all transactions on the account, including your address. if any charges are suspicious or unrecognized, freeze the account immediately and file a fraud complaint with police and copy to bank.

2. if the check is returned stolen/fraud, what'll happen is that the bank will contact you and your husband.

you explain the situation. then you fill out and file a police complaint for fraud and forgery [or whatever the case is].

then you pay the bank as you would have anyway.

the police chase the 'friend' for the crime he apparently committed.

If he's written you a bad check, it will eventually be dishonored by the bank (i.e., it will bounce).
