Yes, but it should be up to the people who own the bar or restaurants to allow smoking or not.
I think it's commonsense that went it to law, meaning people should know when to smoke and be courteous to others.
Sadly someone didn't know this, so a law was forced.
I found this question interesting; and I was thinking.
What if you wanted to open a place just for smokers?
A smoking club or house, could the government say “no, you can’t have smoking”?
That would defeat the purpose of your establishment, wouldn’t it?
There seems to be a demand for such an establishment with all the bars and restaurants going out of business.

It infringes upon liberties, not "rights." Nobody has the "right" to smoke, they simply have the legal authorization to do so. The law has long regulated when and where you can legally drink alcoholic beverages. Why should tobacco be any different?
No, I don't personally agree with smoking bans...but if they are passed by voters, it can't really be argued that they aren't fair.

Yes I think it does but consider this. Drugs, alcohol and smoking are all addictions but if you have a drug or alcohol problem they say you have an illness. With Smoking it is deemed as self inflicted, but realistically the other two are as well. With this in mind, the government have done nothing really to kerb drink and drugs. They have had 24 hour drinking and re-classed certain drugs, that is why I think that smokers have had their rights infringed by banning smoking in public places.

most likely u people do not think in the long term..yea this is fine for me because i dont smoke..screw those smokers but i personally dont care about the smoking ban for the simple fact that if i owned a bussiness now i have the government telling me what clients i can have? ok so yea they can go without a cigarrette while they are here at my establishment but then if i have a resteraunt and some clients are here and the meeting runs long or they need to go outside to have a smoke well there gonna try and find a new place for the next meeting or if its winter and its cold out but that part i could care less about now what about the fact that weve just lost a right...we live in the USA the land of freedom which sadly is becomeing the land of freedoms were losing..as it is already we get our laws and freedoms attacked daily by shrewd congressmen and politicians and the worst part is they keep trying to slip these things through while us as sheep are clueless to the inevitable onslaught of freedoms being taken away...i wont get into wgich side does what because the simple fact is that a politician is not there to uphold our rights anymore...they are there for their own selfishness and money/retirement gain they dont give a rats *** about you or i..they care about who gave them the most money to dictate their vote. back to the topic at hand i forgot what state but they stuck a $1.00 tax per bottle of water (bottled water) well those who dont drink water dont care...but now in another state they have banned bottled water altogether because they werent selling enuff city and sewer water to keep the water and treatment plants runningthose of u who keep saying "o thats not big deal to me cuz i dont eat spam" or "i dont use baking soda so it dont effect me"
the more we let slide through our fingers the more of this great country were throwing in the trash
dems and libs and everyone in between had better start pulling their heads out and banding together if we want to keep any rights at all....is it infringement...maybe not..maybe it is keeping the world safer and healthier maybe next they can make fast food illegal and from there maybe theyll ban all restaurants for being a "choking hazard" u might laff now but just wait..some moron will choke on his chicken (lil pun intended..lol) but he will sue a restaurant for almost choking to death becuse he forgot to chew his food and then well have some @#^%#@^% politician say screw it well ban it
if u have a hard time beleiveing this ..sit back and watch and wait...cons and libs dont need to agree on everything but they should atleast agree to keep AMERICA a free country as it should be!...

Just an odd correction or two. I am a neck breather and have no voice, only an electronic one.Never have smoked or drank, but have had throat cancer twice amongst other things. All my family have died of cancer, some smoked, some drank, some did both but apart from dislike by some to smoking, there is nothing that links cancer to smoking any more than certain foods may be a trigger to cancer.I am not defending nor attacking the social side and its not fair to subject others to it but for the right reasons, you dont like it.Should i ask for compensation from customers whose cars and lorries i repaired when em missions didn,t get a second thought, but no point, why, because as a non smoker its hereditary, plain and simple. But as i said it could be a trigger as with many other things, like alcohol saliva,so right reasons only please, not just i don,t like it.

Smokers don't HAVE any rights!
As an ex-smoker I can see both sides of the argument. I now hate the smell of smoke whereas before I probably wouldn't even have noticed it. I DO believe that if people want a smoke-free environment then they should have it.
However, I also believe that if you want to smoke you should be entitled to. Before the smoking ban many companies had a room put aside for smokers and that seemed to work fine. Some pubs and hotels even had separate bars for smokers and non-smokers. Airport departure lounges had an area with strong filters or extractors.
This seemed to appease everybody, so why did they have to bring in a complete ban? Why not allow small pubs to choose to be smoking or non-smoking? Encourage companies to put one room aside. Smokers SHOULD have rights too.
And for all those who are misguided enough to think the government are doing it on health grounds, if that was the case, they should have made cigarettes illegal - but they won't because they make an absolute fortune out of smokers!

Its our choice, isn't it? We are all adults,we have personal responsibility. The government is there to advise and supply us with actual, factual and un-biased information. Freedom allows us to make our own choices,as adults we can listen to advice and make up our own minds, True? In the free world, governments are there to advise, true? If something was so very bad for our health, they would ban it immediately, wouldn't they? In fact the government shows its true thoughts on smoking everytime they moan about lost revenue from tobacco smuggling. The true facts about smoking are covered in a smoke screen.(and its not tobacco.)

No, because you still have the right to smoke if you want, it just means that you can't poison the people sitting next to you in a pub or office.

NOO!!!! because your smoking is your personal choice! So why should people who choose not to smoke have to be subjected to 2nd hand smoke??? If you want to smoke you can go outside but what about people who choose not to smoke. The whole smoking and non smoking sections in public places does not work you can NOT section off air everyone is breathing it in even if it's from across the room. As a new mom of a 7 week old baby I don't want my child to be around it at all and sitting in the non-smoking section does not grantee he's not getting 2nd hand smoke. The smoking ban is to protect the rights of non-smokers not to punish people who choose to smoke.

i smoke about 40 a day maybe more or less
I'm happy to go outside to smoke its no problem for me I'll gladly go out doors if it stops anti smokers whinge and cry about their right to enjoy being in doors without my fumes. since the ban came into effect this year in the UK I've thankfully not had to put up with these heath nuts kick up a stink about my habit. oh and if anyone these days complains about me smoking out doors i always put the ciggies out on the face of the jerk who annoys me.
don't smoke don't drink go to the gym eat healthily die any way
