You just go to the bank and sit down with a counselor. They will take care of getting the account set up. Be sure to bring ID with you.

Generally speaking, you are the only one who would have access to the money. However, if you defaulted on payments, and a judge ruled against you, then your creditors may be able to get at the money in your account with a court's approval.

If you have been sued thru the courts and they have a judgement yes they can go after your money in any bank account.
