They charged me w/ my tab, which I signed and approved, and another customer's tab, which that other person signed and approved. I showed the manager a print out of my bank statement showing the tab that was charged wrongfully to my card. The manager refused to pay me. Can I do any legal actions regarding this matter?

just dispute it with your credit card company.

Much faster & easier than legal action, and the credit card company always sides with the cardholder if the merchant doesn't have your signature.

If I were you, I would send them a certified return receipt letter explaining that you were charged with another customer's bill, and when confronted with the evidence that they refused to refund the erroneous charge. That is a legal record (the signed return receipt) that they received that letter. Then go back to the place, and ask the manager if they got the letter. When they acknowledge this, tell them that you plan on taking legal action, along with contacting the Better Business Bureau and the state Attorney General. Most likely they will be a little scared and just give you back the money.

Just contact the credit card company and refuse to pay the bill. You may have to put the restaurant on written notice and furnish the credit card company with a copy of the letter.

If the manager persists, call the police or the DA and see if you can file attempted theft charges against him.

Dispute the tab in question with your credit card company. they will take the charge off and send you a form to fill out. Fill it out and send it back. They will investigate the restaurant and make them show proof of the charge. As long as you did not sign for the bogus charge, you have nothing to worry about.

WELL , THE TRUTH IS IT DEPENDS WHERE YOU ARE DINING AT . A LOT OF RESTAURANTS HAVE A PERCENTAGE OF YOUR BILL THAT WILL GO TO A TIP , LIKE A 100 BALANCE IS A 10.00 TIP . HOWEVER IN SOME CASES WHEN THE SERVER RINGS UP THE CHECK AND SCANS THE CARD HE OR SHE WILL ADD ON A SEPARATE TIP AFTER THE CHECK IS SIGNED AND IT WILL GO THROUGH .. THE BEST THING TO DO IS AT A RESTAURANT WHERE NO GRATUITY IS INCLUDED OR CHARGED CONTACT THE MANAGER . I HAVE MANAGED SEVERAL RESTAURANTS AND THAT DOES HAPPEN A LOT . A DOLLAR HERE A DOLLAR THERE MOST PEOPLE DO NOT LOOK THAT CLOSELY AT THERE STATEMENTS . I ENCOURAGE YOU TO CONTACT THE MGR AND EVEN THOUGH THEY WILL NOT CREDIT YOUR CARD BACK THEY WILL PAY YOU IN CASH AND MOST LIKELY TERMINI ATE THE EMPLOYEE .

If it was 2 separate line items, which it sounds like it is, then contact your credit card company as a dispute. Also, write them formally as proof of you contesting the charge.

Send this registered or at least 2 day priority where you can track proof of received at the company.


The reason for the letter is for legal documentation purposes as good faith you are wanting this corrected vs. verbal. Customer service people do not always document accurately your phone call. This takes away misunderstandings. You may call first to at least have documentation you are contesting in writing the charge. Now they will need up to 30 days to come to some resolution upon receipt of your letter. You may call them about 2-3 weeks after your mailing to confirm they have your letter and are taking action. Find out their turn-around and process for resolution.

Contest the charges with you credit card company.
It may take a little time however, you will eventually be refunded if the vendor is unable to establish that you signed for and therefore accepted those charges.

Call the number on the back of your card and they will take it off.

Call your CC company and they will dispute it for you, most will give you a conditional credit until the matter is resolved
