It depends on where he lives and what the state laws there requires...In NY, child support is based on a father's total gross income and how many children he has....Whether it's one job or two they combine his salary ...If the mother of your brother's child finds out that he has another job she can petition him back to court for an adjustment... So he might want to consult with a legal mediator of his legal rights...

Wow- all these answers are different.
Actually - it is only if the Ex decides to take him back to court. Even if it gets modified every 3 years - when they do that - they don't ask for his paystubs - they do a 'cost of living' amount (not based on how much more he earns) - so, No, not unless the ex personally asks for an increase - but, just make sure he doesn't rub it in that he has extra money from this job- because that would be a reason to get it increased

they can only have CS modified once every 3 years or if there is a "significant" change in circumstance and I think that change is like 30% and taking on a second job would not be considered in that calculation as its "above and beyond" what would be considered a normal workweek or job responsibility. Just as with OT they don't consider that a guaranteed source of income so generally (sometimes it is) its not factored in. so have him take it on.
Just an FYI I pay over $1100 among other things.

Boo Hoo, he has to support his kids. I am tired of hearing the cry babies who thought it was fun while they were on top for those 2 minutes but can't man up to their responsiblities and cry over how much they have to pay. Your "brother" is getting off cheap with only having to pay $500 per month.

Not unless his Ex finds out he's working two jobs and takes him back to court to ask the judge to up her child support. Otherwise, his child support is $500 regardless of how many jobs he has.

If your brother is having that much trouble paying he can take the ex to court and have it reduced. Now if he is having trouble paying it because he is going out and spending money on stuff not needed or brand new stuff(like a new car and such) than he needs to stop whining and suck it up those kids are is his responsiblity also.

It won't happen automatically, but it's possible that his ex could take him to court to get an additional amount based on his new income.
Depending on what you mean by "a strain on his finances"- he might have some other avenues. If he doesn't have enough to live, he should see if he can get his order reduced. If he has enough to live but not enough to do the things he wants to do, then he's out of luck.

Yes (unless it is under the table and he keeps hush) because the child support goes by his income so the more he makes the more he will have to pay.

If the ex finds out he can take him back to court and get more money. Perhaps he can cut out some of the non-necessities, like cable, internet, cell phone, eating out. All these are not necessities and could save him a lot of money.
