My daughter is being accused because her boss said she was acting like she was on drugs during a x-mas holiday event. Being a concerned parent I took her to get a drug test and the results were negative, now I would like to sue his manager for defamation, and being falsely accused and relaying the message to all her co-workers that she was on drugs. What are my options of suing this guy? NO alcohol was served during the holiday event therefore she wasn't drunk and she was driving (not that it matters for some kids) but I saw her when she got back from the holiday event and actually told me the same night that her boss was telling everyone that I was on drugs... I know there are two sides of the story and will confront the other side but for now I would like to know what my options are.... thanks a lot!

Seek a consultation with a tort lawyer who works on contingency.

The problem that may arise is that the lawyer will say what are your damages. Was your daughter fired from her job? Was she so upset that she saw a therapist?

The other possibility is that it could conceivably be seen as a case of discrimination or harassment. Call the EEOC and ask.

You got a drug test that very night?

people can act "like they are on drugs" for lots of unintended reasons, such as being dehydrated, being excited at the event, some over the counter medications, too much caffeine combo of any or all the above, and so on...

be careful about being overbearing over routine party small talk....it was a party! or you will find your daughter is fired, because frankly, who needs the aggravation, and she is easily replaced.

You are probably the only one that remembers beyond the next morning.

She has no damages so there really is no suit. However you may certainly seek an Attorney who might even take the case but its doubtful he will do so on a contingency basis. This could costs thousands with no return. Its also very time consuming will take at least a year I would guess

You will have to prove that she was damaged monetarily, and it doesn't sound to me like she was. It just sounds like she has a jerk for a boss.

So you need an unethical, ambulance chasing scheister for a lawyer, because a decent lawyer won't take the case.

Just my opinion!
