The laws may vary from state to state, but if she is NOT on welfare, then I believe the state will not automatically apply for child support -- she would need to apply for it herself. Sometimes, child support can be written into the custody agreement.

The mother can opt out of child support but usually it is awarded by the court. I don't know about Ct. But I do know that the parent paying child support in the state of Michigan has to pay to the Friends of the Court who then sends it on to the custodial parent.

If you are already paying child support without any problems, the state should not have to get involved. If you both have a dollar amount you are both agreeable with too, the state's involvement should just be to put in writing what you 2 have agreed on.

she doesn't have to get it --- but, watch your back. She will tell YOU she is not going to ask for it - but, once she gets custody - what do you think will happen? You guessed it - she will turn around and ask for child support- and then you are screwed- and there is no undoing the full custody part of it.

Yes is the answer. Normally with joint support then the child support is waved because you have 1/2 custody and responsibilities. Good luck and God bless****

Mom can decide if she wants to go through support enforcement -as long as you pay regularly and she is NOT on public assistance you can pay her directly(always write a check or money order so you have proff that you paid)

I believe that she can opt not to ask for support but it is one of the things that the court will ask her and she will have to notify them if she wants money or if she wants to sign something waiving her child support.

well. it depends. when my dad got custody he told the court he didnt want any child support..but the court basically said too bad. they went after my mom anyway.
