the other thing is she went to the court house the day after we contacted her and gave her the paperwork and they told her he did not have to appear in court only here bc it was not a major offense. so he did what he was supposed to do. no money was transferred yet bc it was a family attorney. and she was not making us pay upfront. and the court said that he needed an attorney. bc he was facing 3 months in jail.

Is she alive? Out sick? Did you contact the court and see if she filed for a continuance? Did you let the judge know your atty is missing?

Start there.

You forgot to tell us how much money BF paid at the front end of the deal. If there was an exchange of money, then the matter is not one of getting a new lawyer for the warrants but also for the presumptive contract, if money did change hands. I would say that there is substance here, money or no, for a complaint to be filed with your local bar association.

I have lead a fairly aggressive and unconventional life. My one chief behavior curb has been, "Will this require an attorney for my defense?" I have had the good fortune to err to the plaintiff side. Then I contact Rabinowitz Rebinowitz Washngton and Haddad. (Nod to Archie Bunker)

Attorneys are only there to stand between you and the court. It is the individuals responsibility to appear no matter the circumstances.

First, the warrants were not issued because the lawyer failed to appear, they were issued because your boyfriend failed to appear. If he had showed and the lawyer did not he could have asked the court to continue the case.

The fact that the lawyer has the paperwork does not change anything either, he should be able to get copies of everything.

He really needs to find another lawyer.

What the lawyer did is not necessarily illegal, however it is improper. You should report the lawyer to the local bar association.
