my friend is going to court today. hes being charged with driving without a license, failure to control and he is only 16 years old. he smashed into a pole driving his friends car. but he goes to court today and he already has a drug charge for bringing marijuana to school from back in april. the question is is my friend going to DH and for how long? someone please tell me its all ive thought about all day....

and trust me i aint dumb enogh to do wat he does. but i care for him hes my best firned and hes going to court so im really worried. does anyone have any guess how long he;ll be gone?

he got on probation for the drug charge and had to go to drug conceling. he is on probation at school but not on lyke law probation

pplz give me more answers guys. i am freaking out and imm at school. i got out in lyke a half hour and then i gotta go so plz try to help me. i aint dumb i dont do stupid stuff. i dont even drive with him in the car.

It depends on the exact charges
It depends on his entire criminal history, not just the stuff you know
It depends on what state this occurred in
It depends if they try him as an adult.
It depends on the judge.

Anyone that gives you an answer is guessing at best.

You are not telling enough about the marijuana incident, what were the charges and what was the probation of the offense? Depending on the state, he may loose his license until he is 21, go through mandatory counseling, and pay restitution for damages. In WI, he might fall under JIPS, Chapter 938, "Juvenile in need of protection and or services", and face a more strict penalty if the judge feels it is necessary for his well being.

No one can predict what the judge will do. But the judge is going to conclude from the facts that your friend is reckless and irresponsible, even for his age. So the judge is likely to be thinking: (a) Can I find some program or treatment of some kind that might help this kid gain some maturity? or (b) Is punishment the only thing this kid can understand?

So, what your friend says to the judge, and how he says it, is going to be of supreme importance-- if he can convince the judge that he knows that he has no ability to make rational decisions and that he wants help in dealing with this problem, then maybe he can avoid imprisonment.

I'd say your friend is up chit-creek.....and it would behoove you to find another friend....one who may raise you to a higher level, instead of dragging you down into the sewer.
