Good point. How do you define payment? Will marrying a rich footballer purely for his money constitute a payment for sex services. Also, have you noticed how the feminist Harman wants to make it illegal to 'pay' for sex and not to 'receive' payment for sex. A clear attempt to criminalise the man and not the woman. (Stopping sex trafficking is just an excuse for this legislation, that is how New labour operates)

Any contract/agreement which is not enforceable at law is void. You have to understand the difference between the two. Under law your conjugal relationship with your wife does not fall within the ambit of sex trade. However in case you are buying something as a gratification after indulging in sex that consideration would be viewed as void and illegal.

No, you can marry her if you want. The marriage proposal is not illegal. The act of exchanging sex for value (money, diamond ring, food, movie etc) is prostitution and that is illegal.

prostitution is illegal for the safety of the chick or gay dude doing the selling. morality has nothing to do with it, you should look at the crimes committed on prostitutes, they are targeted for hate crimes due to societies view of their low morale and also targeted by serial killers. There is a big difference there. If it bothers you so much to give someone an engagement ring then dont get married and make sure your partner works too.

There's a lot of case law built up around diamond rings and broken engagements. I doubt any new law would overturn that.
The new law sounds like a very circuitous way of prosecuting prostitution, and would probably be evaluated by the courts in that light.
