Get to a lawyer quickly and have a separation agreement drawn up before you leave. Once you've established your legal rites you can run!

if you move out and your name is on the mortgage then you are still help responsible for that monthly payment if he can't make it. It really doesn't mean nothing to have your name on the mortgage... its just another person for the bank to go after for the money...its the deed that is the important thing when it comes down to selling it.

Off the mortgage or off the title? You all have to refi in order for you to come off the mortgage and then you have to sign a quit claim deed to be off the title. You can leave but you're still responsible for the loan for now.

If he is physically abusive you can file for an order of protection and he will be forced to leave. Do not leave your home, he will not make the payments and your credit will be ruined for a very long time. This is alot to deal with I understand but if you let him ruin you financially as well it will affect you for much longer. Be smart about this and use your head, leave your heart out of it!

Go to Family self help center in your area and seek shelter immediately before he hurts you.

Did you call the police? Take action. About the mortgage, you can deal with that later after you protect yourself.

You are responsible for the debt whether you live there or not. The mortgage company does not care where you live as long as they get their money.

Once your name comes off the mortgage you have no claim to any of it>He has to refinance it>Can he carry the loan with out you>???
