Who has ever been evicted from a house that you've rented when the land lord will soon face foreclosure and you'll be evicted? My friend Sharronda will have nowheres to go. Are there any renters rights at this point? We live in North Carolina and she has a 3 year old baby girl. She's single and has no savings account. Isn't Pres. Bush doing something for people who go into default? Will this help Sharronda? She has until January 15 to get out.

She needs to be finding a place to live. Have here go to the DCFS (Dept. Children and Family Services) and see if she can get some assistance.

She has the right to a 30 day notice, in writing.

Unfortunately she is going to need to move. She should be taking this time to find a new place to live. If she is in the property when the foreclosure happens the new owner (tha bank) will evict her.

I was in a similar situation about 10 years ago but used the situation to purchase the place that I was living. It was the first property I owned and it immediately became a rental property and I became the landlord as I had already found another place to live.

The recent agreement on subprime mortgages extends only to owner occupied homes, so it won't apply in this situation. Sad to say, she has no renter's rights here. As soon as the new owner takes possession, her lease is effectively terminated, since rental agreements do not transfer in cases of foreclosure. She can stay in the house until her eviction notice arrives, which will be within DAYS of the lender taking possession. At that point, she had best be prepared to move elsewhere.

The federal program is for the homeowners, in this case the landlord, and I heard it is NOT for people who have missed any payments, which it sounds like this homeowner has. I don't think Sharronda has any rights in this issue, so sorry.
