Sorry, can't be 6-4! There are only NINE (9) justices on the bench at any time of the United States Supreme Court.

The court was split until the late Chief Justice Rehnquist casted his deciding vote, so the decision was 5-4.

The other four conservative justices were:

Scalia, Thomas, O'Connor, and Kennedy

By the way, the issue wasn't for deciding who was the president. It was for deciding the constitutionality of the vote recount in Florida. Bush was merely a beneficiary because of the needed electroal vote as the outcome of the case.

First, it is important to note that the Justices were not voting "Bush" or "Gore." Based on the initial count, Bush won Florida, but Gore was seeking recounts. The Justices were deciding the issue of whether or not the recounts were allowed under election laws. They eventually voted 5-4 to STOP the recounts, upholding Bush's victory.

Second, it was not Rehquist who cast the deciding vote. Justice Kennedy waffled for a while, then eventually voted to stop the recounts.
