we thought that we had a leander helping us to keep it from going into foreclose but for some reason it was sold right from under us in the month of Sept. this year and I did not know until yesterday 12-19-07. If anybody out there know anything that I can please let me know.

I did not get anything from the courts it was someone working on paper work for my neice in orderfor her to do a probate deal and was told that at the same time he was doing a refi so that the house can get in her name. She told me that she had a visitor come to offer her some money to move out, I swear that there was not a letter sent to me for anything. I decided to call and ask why was some one going by the house and offering her money to move that's when I we both found that the house was sold back in sept. this year.

That reason is because you were not paying or meeting the terms of any agreements you had made.

I merely echo the others, there is no way you did not know you were being foreclosed on. There is a court procedure you had to be informed of and then a myriad of letters from them including a possible Certified letter or two.

So to make believers of us and so that we may help you further what exactly happened here.

There is a possibility we are wrong and they committed fraud so if that is true then report it ot the FBI. This is not something you should be determing however, so what is your ATTORNEY saying about this issue? You do have an Atty, right?

First of all a lender who decides to put your home in foreclosure must file with the courts. The attorney who handles the foreclosure would send out a Notice of Default to you and also file it in court. If you did not receive the notice or don't remember being given a notice than you may have not been working with someone who claims to be a lender. Scary thought I know but it happens more often than not. I have a few questions I'd like you to think about.....

Were you at least 3 months behind in your mortgage payments?
Did you contact your original lender not some company that states they can help you?
Did you hand over the deed or the note to this company?

How did you find out that your home had been sold?

Really think about these questions because it will make you think about maybe seeing a red flag somewhere along the way. Unfortunately, you won't be able to do much because if it was sold the new owners are going to want you to move or ask if you want to rent it.

Dear, it's IMPOSSIBLE for you to not know that your home was sold under foreclosure, unless you refused to open mail items and accept official court notices. Homeowners must be duly and legally notified of all pending court activity due to this foreclosure.

If you somehow managed to avoid all these notices, I'm sorry. If the house has been sold, it is no longer yours.

Your only chance to regain possession lies in your state's laws. There MAY be a redemption period during which you can pay all that is due and have the sale nullified. This however, will not be inexpensive, since you will not only have to pay the past due amounts of the mortgage itself, but also any costs incurred by the lender in processing the foreclosure. Such costs run into the thousands of dollars.

There is no way you can not know. You get mail ! Sorry for you though. It is up to you to keep in contact with lender. You have up until the hour of forecloser to take care of this. Our lawyer did nothing for us. We had to do all the leg work or we would have lost our place. The mortg. company would not even speak to us on the phone. They were trying to foreclose. We made all the back payments. That is all they wanted.
