I was coming out of a local restaurant/store and the steps where icy, and concrete, i was also carrying my 1 year old daughter, i slipped and feel down all the stairs still holding my baby(thank god she wasn't hurt) I went back in and told the worker what happened and nothing was done i phoned the owner several times and left messages finally i got through to his wife and she was so rude about it and to top things off i didn't get a sorry not once. My legs are busted up, bruised and hurts really bad........and the steps wasn't sanded or salted......what should i do? is this a law suit and do i have to go to the hospital for a law suit?

I believe that you can sue because their was nothing done to wipe the ice off, so it created a dangerous situation. I don't believe you have to end up in the hospital to sue them, I would speak to an attorney and see if they will take your case. Your lawyer can supeana all witnesses that were their provided you have their contact information and the camera footage. You may be able to sue for pain in suffering and you have to bruises to prove it. The bottom line is you should contact an attorney right away and tell them everything you ask on yahoo answers, they will advice you of how to proceed.

I do not think you have a case. As your story telling us you left the restaurant/store and the steps where icy, so the store or the restaurant has nothing to do with the steps being icy and slippery. If this is the case you can sue every establishment with icy steps & slippery staircases.

You didnot get any sorry remarks obviously you were also aggitated answering her or her remarks. I do not think you were soft spoken at those times on the phone after you slip in the icy steps & fell down the stairs. Eveybody wouldn't be nice either after that.

What should you do? Then go to the hospital for check up if you were badly injured & few examination could determine it. If you think this is a law suit then proceed with your own judgement, but from my own point of view you got NO CASE, this is absolutely a case of accident on your part, which you donot like either. Suing the store would definitely take time, if you can affort the time & the money then you should file a case, but in this early on just telling you are just wasting your time.

You need to consult with a lawyer unless you just want lost wage or doctor's bill reimbursed. Small claims court can only judge on cases where documented costs are involved. To go to any higher courts, you definately need an attorney to represent you.

You need to be seen by a doctor and get your injury documented. How else would you tell the court how badly you were hurt? "They were rude" mean nothing in courts. Also, "hurts really badly" mean nothing either. You will also need to prove the restaurant/store had a duty to clean the area, and they clearly neglected to do so. Don't just assume they do...

Personally, unless physical injury beyond just "pain" were involved, and someone was clearly at fault, I wouldn't bother with lawsuits.

To prove some sort of tort (civil lawsuit) you gotta PROVE that they had a duty to sand/salt the steps, that they neglected to do that, that the slipperyness caused your fall, and that you suffered damages as a result of the fall. If you can't prove your damages, you might as well just forget about it.

You could try suing them, but usually only if you were injured or had to go to the hospital for treatment will they take the case seriously. Try calling small claims court and tell them your case. Its worth a try.

go to the hospital and start your medical workup if you have one...then contact a personal injury attorney.

In the US, everything is a court case. Sue their *ss off.
