I was awarded resitution by a court order last Sept. I was suppose to receive 1/4 of the money within thirty days and the rest within six months. I has in a shooting incident and the guy that shot me hasn't even paid me half of what he owes. Is there anything I can do to get my money or get him put in jail for not paying. I have hospital bills that I have to pay and he is walking free while I am struggling to pay for what he did. Please give any advice that you can! The District Attorney's office acts like they don't even care.

Thanks, Matt

Welcome to the no-restitution world. The DA's office doesn't care because their job is done. You were not a party, so you have no standing to file a motion of any kind. Your best bet is the probation officer assigned to the case, but remember that the PO has spent more time with the perp than with you. The PO can threaten to violate the perp - if the court made it a condition of probation. Some states have made it easier to enforce restitution, so check with a lawyer of victim advocate in your state.

You need to go back to the court where restitution was ordered and inform the court that the person is in violation of the order. The judge can cite him/her for contempt. Start the process by contacting the DA to prosecuted the case.
