The itouch is picking up like 5-8 wifi servers but can't connect to any ?

You can use wifi but some have passwords to protect anyone from logging on and some may have weak signals (because you are too far away), causing your inability to connect.

The answer is yes to using WiFi. The answer is maybe to the legal issues if your trying to hack into someone wireless network. If no password is required and your iTouch picks up the network, don't worry about legal issues. Apparently someone wanted to provide this wireless connection for free. Some restaurants or business do this to attract more customers; these areas are also known as hotspots. I think Starbucks and Barnes and Nobles does this at some locations.

You can use any,but some are locked and will say stuff like,WPA,WEP,WPA897-TSK,and such means you can't use them,hope I helped.
