my grandfather passed away 3 weeks ago in hospital
he told all of us he had a will but its cant be found..
we have checked through his house and can only find a copy not the original...
what will happen ??

if you have a copy that should be enough to start with, however with my grand father he hid things in books, behind paintings, in cupboards and under the drawers in his dresser.

first the family needs to continue searching for the original, second they need to meet with a lawyer with the copied version and see if it will be honored. - it will help if it was signed by a second party and if they are still alive to testify to it.

really hope you are able to find it, losing family is hard enough with out going through more stress of wills, laws and ethics.

and yes with out any form of a will it would be divided among the surviving children however they could lose as much as 60% to taxes.

Call the attorney who prepared the will. Maybe they have the original. If not, the estate will be split between his heirs.

Keep looking. A family attorney? Otherwise, the probate court will make the decisions.

if you can find out the lawyer who did the will , he or she will have the original document or will have it recorded in the county courthouse.

His estate will be divided equally among his children.
