My roommates and I have been living at a house month to month. Our one year lease ended in October and nothing happened; we just kept paying rent. Our landlord wanted us to sign a 6 month lease starting 1/1/08 for $1000 or a month to month starting 1/1/08 for $1250. We decided to sign the 6 month lease and turned it in two weeks ago. Later that week I found out my girlfriend was pregnant so I wanted out of the lease to move in with her. My landlords will not let me out even though it hasn't started yet. Also, shouldn't I be able to get out of the lease within 30 days from the day I sign it. For the city of Appleton, WI

If the lease has not started yet then your landlord can not hold you to the terms of the lease. However, since you have been on a month to month basis you still have to give 30 days notice. Have you spoken to the landlord regarding your situation? Could your girlfriend move in with you? Explain to the landlord that if you are not able to get out of the lease then your girlfriend will have to mnove in with you (make sure that there are no terms in the lease about occupancy or guests staying for a certain amount of time) If the landlord does not want a third person and eventually a fourth (the baby) he will terminate the lease. You could also help your friend out by looking for someone to take over your portion of the lease. Then bring a 30 day notice to the landlord along with the name and information of the person that is willing to take over the lease. If all else fails get a lawyer. I had a similiar problem where we paid a deposit on a townhome that was being built. We were not moving in for 3 months. In the course of that time we were involved in an accident, We contacted the rental agency and backed out of the deal. They refused to give us our deposit back and we had to take them to small claims court, We won. So keep working on the landlord do what you can to find a person to take over your lease and if all else fails move your girlfriend in with you

Actually your lease never ended bacause once a written lease expires a verbal lease is in place until another lease is written and signed. Since you also paid rent during that time it shows an understanding on your part as an agreement with the landlord showing you as the tenant.

You don't say what state you are in but if you hadn't already signed the lease you could of given a 30 day notice to the landlord and that would of been it. Since you signed a lease, you are legally bound to it.

There is no provision whatsoever in Wisconsin for getting out of a lease within thirty days of signing same. A lease becomes valid and binding the very moment you sign it and give it to the landlord. The fact that the lease term does not begin until January 1 is irrelevant. The contract is signed, and is therefore binding.

You signed the lease and it is a binding contract.

The landlord has no legal obligation to let you out of the lease without consenquences.

There is no law allowing you to get out of the lease after signing.
