He was getting at the current separation of church and state is not what our forefathers had in mind as evidenced by the following paragraph.

Ever since the Supreme Court erroneously elevated Thomas Jefferson’s “wall of separation between church and state” metaphor to a constitutional doctrine in the 1947 landmark decision Everson v. Board of Education, a growing sort of legal fog has been setting in on our constitutional religious freedoms, ending in what can only be described as a requirement of government hostility towards religion. This is, of course, not only a far cry from what our founding fathers intended, including Thomas Jefferson — a staunch religious liberty advocate — but it is a far cry from what “We the people” intended when the Constitution was ratified.

First line of the article for those that want to skip the religious rant of the article:
"Okay, so the headline is a bit premature, but it’s the logical precursor to the legal philosophy of liberal extremists, isn’t it?"

So your headline is intentionally misleading. I call this a lie.

The OPINION of someone that so obviously supports religious freedoms for anyone as long as they are Christian is not a good place to start.

There are no grounds for which a court could find a letter that predates the constitution to be unconstitutional.

What bothers me even more are the 3 people that responded like religo-bots to the headline (obviously without reading the article) like it was true. "Must have been a Clinton appointed judge..." Must be a lie.

The Declaration of Independence was a letter to King George. It has no significance other than historical to modern Americans.

It outdates the constitution. What the judge is wasting his/her time on is unconstitutional.
