hi, my best friend is in a bit of trouble. a few nights ago she totaled her car (she is incredibly lucky to be alive and even luckier that no one else was involved in the accident). At the scene she blew a .28!! and with her injuries she was taken directly to the hospital instead of to jail. i am not sure if or how the law differs if you are that far over the legal limit or if an accident was involved. I only know the ramifications of a "regular" dui. Would it be wise for her to hire an attorney? will it do any good? she has no prior record, will she be facing any jail time or other severe penalty like loss of license? thank you for any help or advice you can give.

i do find the answers coming in to be amusing although lacking in any helpful advice whatsoever. Please refrain from commenting on my friends' irresponsibility and her "drinking problem"; that is not the issue at the moment. the alcohol awareness classes should cover that in detail as well as the AA meetings which she will be court ordered to attend. She realizes that she made a mistake, and as i stated in my question, it was her first and only offense of any kind and she understands the severity of her situation. All we are trying to determine is if certain dui's weigh heavier than others and what the difference in sentencing is. Serious answers only please. Thank you again

It's always wise to hire an attorney when you're facing jail time or any kind of legal trouble. That being said, I hope she at least gets her license taken away because I can't stand irresponsible people who don't care about endangering other people's lives.

Any time you are facing criminal charges, you need an attorney. Not having an attorney in that situation is like performing surgery on yourself: not a good idea.
More than likely, the DUI charge will be "enhanced", meaning the ramifications and the level (this definitely won't be a misdemeanor charge) will be more severe.
My guess is her license will be suspended for some period of time, at the minimum (any DUI will get your license suspended). Yes, she could be looking at jail, but not prison; this is why she really needs to hire an attorney.

Your friend should contact an attorney as soon as she is able. With the right representation, your friend will likely receive far less punishment than if she was unrepresented.
Your local county bar association will have a referral service where you can find a reliably good attorney fairly quickly. These bar associations are easy to find by searching the internet.

She's lucky to be alive.
Yes, she SHOULD hire a lawyer.
At that level she's got no chance - even on a 1st offence - of getting it down to a wet reckless. She's VERY lucky no-one else was injured, or there'd be mandatory felony implications.
She's facing a misdemeanor criminal charge in addition to the DMV consequences. She should hire a lawyer who "might" be able to keep her out of jail.

its too late since she took a blow test, she is loosing her license and may be looking at some jail time. Perhaps a good legal attorney in the town she was in can help her out but it will cost

If she can afford a lawyer she should probably get one but you are right she is lucky as hell to be alive and that no one else was involved I hope she DOES lose her license cause I sure as heck do dot want her dumb drunk a$$ running over anybody I love.

If not, then make them burn her, with appointed trash, like they do everyone else. Attorneys CHURN cases, baby. Even if you pay them.
But your girl blew a .28, SO DON'T BLOW OFF GOOD MONEY, AFTER BAD. Don't buy her another car, anytime soon.
